Franklin County Probate Court: Changes to New Estates Process

Beginning 2/23/2026, the court will no longer be issuing a Legal Notice of Compliance in new full estates. Filers will not need to wait for a Legal Notice of Compliance to submit proposed entries. The clerks will still issue an initial Notice of Compliance to prompt filers to upload proposed letters of authority.
In testate estates, the court will issue the Entry Admitting Will to Probate.
The new procedure is:

  1. Open your case.
  2. If you have an original Will, deliver it to the court.
  3. Wait for the “Notice of Compliance” to be filed.
  4. If you have a Will, wait for the Entry Admitting Probate to be filed.
  5. After the Will has been probated and when you believe the court should appoint your fiduciary, upload your proposed entries, for example:
    a. Proposed Bond Approval Entry
    b. Proposed Letters of Authority

If you need a hearing to appoint a fiduciary, upload a proposed Entry Setting Hearing. You may reserve a “Fiduciary Appointment” time online for the hearing to be held.
