Bankruptcy Court Miscellaneous Fee Schedule

At its March 2014 session, the Judicial Conference approved amendments to the Bankruptcy Court Miscellaneous Fee Schedule. The changes go into effect on June 1, 2014. The change is to the “administrative fee” that is assessed at the filing of every bankruptcy case. Currently, the “administrative fee” is $46 for every case, no matter the chapter. The Judicial Conference had separated the fee into difference categories depending on the chapter that is filed. The new administrative fees are as follows:

  • For filing a petition under Chapter 7, 12, or 13, $75 (currently $46).
  • For filing a petition under Chapter 9, 11, or 15, $550 (currently $46).
  • When a motion to divide a joint case under Chapter 7, 12, or 13 is filed, $75 (currently $46).
  • When a motion to divide a joint case under Chapter 11 is filed, $550 (currently $46).

This will result in filing fee increases as follows:

  • The fees for filing a chapter 7 case will increase from $306.00 to $335.00.
  • The fees for filing a chapter 13 case will increase from $281.00 to $310.00.
  • The fees for filing a chapter 11 case increase from $1,213.00 to $1,717.00.

Finally, the fees for filing an adversary proceeding will increase from $293.00 to $350.00.

Effective June 1. Also of note: the conference is going to address at its next meeting whether the filing fee on sales free and clear of liens may be deferred.
