Bankruptcy Law Institute 2011 - Open for Business

Plan on attending the annual Bankruptcy Law Institute, May 12 and 13, if you are ready to "get down to business!"

In addition to a thorough review of timely Chapter 7 and 13 issues, this year's Institute will also have an extensive program available to practitioners interested in developing and enhancing their knowledge of business insolvency issues, including critical Chapter 11 topics.

A session is planned with William B. Logan Jr., and Anthony J. DeGirolamo, covering the reorganization and restructuring of the financial affairs of individuals engaged in businesses. The topics in this session will include non-bankruptcy alternatives and strategies, bankruptcy alternatives (Chapters 7, 11 and 13), and special considerations for individuals for whom Chapter 11 is the only permissible bankruptcy alternative.

There will also be separate break-out sessions designed for the attorney who practices primarily in a non-business context, as well as for practitioners experienced in business reorganization matters.

For the former, Susan L. Rhiel, and Myron N. Terlecky, will explain the fundamentals of Chapter 11 cases, including the preparation of the case, how to get approved and paid for employment, the role of the US Trustee, operating reports, as well as the process to construct and confirm a plan of reorganization.

In the latter presentation, Judge C. Kathryn Preston, Alan Lepene, and Jeffrey A. Marks, will review issues surrounding the financing of a single asset real estate case, the strategies involved with the election under Section 1111(b) of the Bankruptcy Code, and the developing concepts of what constitutes "fair and equitable" treatment for purposes of Section 1129(b) of the Bankruptcy Code.

Clearly, the Bankruptcy Law Institute will be "open for business" at this year's program!
