Presented by Terri-Lynne B. Smiles and Elizabeth Y. Collis, both of Collis Smiles & Collis, this seminar will provide you with a brief overview of Ohio professional licensure law, the types of criminal charges, convictions and pleas that will affect your client’s professional license, the approaches of the professional boards to common criminal issues, the basic rules of administrative hearings, and an update on recent changes and court challenges to administrative rulings.

 

Included in the overview of professional licensure law reviewed by Ms. Smiles will be discussions and updates on the hearing process, burdens of proof and evidentiary standards before administrative boards and issues on appeal. Her session on discipline for criminal actions reviews the scope of authority for discipline based upon criminal actions or convictions of the most active licensure boards as well as an examination of common terms imposed for various types of crimes and related issues such as nondisclosure.

 

Ms. Collis’s section on administrative case law will cover recent issues in administrative law, including successfully challenging agency rules, scope of practice issues and the effect of tactics in the administrative hearing on the reviewability of the administrative decision. Finally, her session on impaired professionals and their licenses explores the approaches of various licensure boards to impairment and the criminal issues that sometimes arise as a result of the impairment, including a discussion of approved treatment programs, professional assistance programs and the Boards, the effect of treatment in lieu, and Nursing Board’s Alternative Program.
