Voir Dire for Civil Cases
The fourth installment of the Litigation Management Series features Voir Dire for Civil Cases on Tuesday, October 2 from 11:30 a.m. – 1 p.m. for 1.5 hour of CLE credit. Belinda S. Barnes, Lane Alton & Horst will be representing the defendant for the topic while David I. Shroyer of Colley Shroyer & Abraham will present the plaintiff’s side.
In describing the seminar, Ms. Barnes states, “I hope that this session will be attended by those who want to better understand how the voir dire process fits into the overall handling of a case. As discovery progresses in a case, I think about what type of juror I would want. Then I try to identify that juror during the voir dire process. Voir dire is the only opportunity that attorneys have to learn about the jurors who will ultimately decide the case. Too many attorneys don't really listen to what the prospective jurors are telling them. Preparing a specific voir dire for a specific case is essential because every case is different, and thus, the target jury should be different for every case.”
Mr. Shroyer shares that asking the question, “Can you be fair and impartial?” is a complete waste of your valuable time in voir dire. He states, “The key to voir dire is knowing how to ask the right question. The right question will get you the information that you need to make an informed decision about who should be on the jury. In this presentation we will forget the stereotypes and dwell on how to find out what the jurors are really thinking.”
“If you’re an experienced practitioner forget about everything you have done in the past and open your self to a different way of conducting voir dire. Voir Dire might just become your favorite part of the entire trial. It should be your favorite because it is the most important.”
