Tax Act Update Scheduled

~ written by J. Troy Terakedis, co-chair, Business Tax committee

Over the last two years, several new tax acts have been adopted. As a kickoff to the upcoming 2007-2008 Columbus Bar Business Tax committee year, an extended seminar will be held to address the key provisions of this recent legislation that every tax practitioner will want to understand.

The seminar will feature new tax acts including the Pension Protection Act of 2006 and the Health Care Act of 2006 as well as the Small Business Work Opportunity Act of 2007, highlighting not only the important changes to the tax laws which have been made but also tax planning strategies to account for such changes.

In addition, the seminar will address the final I.R.C. Section 409A regulations, including what types of nonqualified plans are subject to these new regulations and the tax consequences to participants in these covered plans if the plan does not comply with certain applicable restrictions. This topic will also provide a primer on the rules for deferral elections, distribution elections, and distribution events as clarified by these new regulations and what needs to be done in order to amend plans to comply with or be exempt from Section 409A.
